Here at TAPTHEMARKET we try our hardest to make things just a little bit simpler and, where possible, a little bit better. That includes these terms and conditions.

We have tried to keep these as straightforward and as easy to understand as we can. We of course don’t always get it right, but we will keep trying.

Here you should be able to find the information you need to understand our relationship with you.

By using www.tapthemarket.com you are agreeing to these terms and conditions.

  1. The Basics

    We are an online professional services marketplace. That’s it.

    We don’t promise to make you happier, taller, more attractive to anyone, be able to travel back in time and do it all again or to solve all of your problems.

    We don’t offer professional (legal, PRO, accounting and consulting) advice ourselves. The individuals, firms and companies (the professionals) who are registered on our website do that. Your relationship with those professionals will be governed by whatever you agree with them.

    If they fall below the standards you expect of them or they breach their agreement with you – you must take that up with the professional directly. We, TAPTHEMARKET, will not be in any way responsible for any problems you have with them or any losses (of any type) you suffer as a result.

    BUT of course, tell us about it and that is the purpose of the professional rating and feedback service which is part of the site.

    We don’t make recommendations, we don’t offer advice.

    The obligation is upon you to comply with the laws and regulations of your jurisdiction.

    If you use www.tapthemarket.com you agree that you are using the site in accordance with these T&Cs.

    Professionals – we will enter into an additional agreement(s) with you.

    Definitions

    Instructions means your job specifications, what it is that you want the professionals to do, your request for professionals to send you their quote;

    Site or site means www.tapthemarket.com

    Terms and Conditions and T&Cs means these terms and conditions (but we think you knew that already);

    We and us means tapthemarket.com and its owners;

    You means, well, you the customer (we think you had that one nailed as well);

  2. TAPTHEMARKET Service

    By using the site or submitting Instructions or by signing up as a customer you agree that these T&Cs, which include the links to our Privacy Policy, regulate our relationship.

    You too will do your bit and you will comply with the T&Cs as well – including some rules of the game around posting of content, reviews of professionals and similar.

  3. Availability

    Nothing is perfect and we can’t guarantee full availability of the site or the services or that it will be error or defect free.

    When you submit Instructions, where possible, it is automatically forwarded to registered professionals. Sometimes this may take longer than at other times. We will endeavour to this within a reasonable time.

  4. Our Fees

    We charge the professionals a system marketing, management and licence fee.

    Where, for reasons of local law or regulation we are unable to collect our fee directly from the professionals, it may be that TAPTHEMARKET will need to invoice you the professional’s fees and our fees, and then deduct our fees from the sums you pay us before passing on the professional’s fees. There may be a further administration charge in this event.

    Regardless of how we invoice, the important thing to know is that all fees are exclusive of value added tax (VAT) which means you’ll always be responsible for paying VAT on top of the fees. TAPTHEMARKET will never be liable for any VAT or other tax levied by any government.

  5. What we are not liable for / Disclaimers

    Sorry, but everyone has them.

    We can’t be responsible for everything, especially with what happens online. As we state below we try to protect our systems but we cannot warrant that www.tapthemarket.com is free from viruses, malware or other malicious code and as such we cannot accept any liability for any loss or damage caused by the transmission of such viruses or codes.

    TAPTHEMARKET may be interrupted or occasionally blighted by errors and defects. We do not warrant that it isn’t.

    We are not responsible for the links of any third party sites.

    We exclude all liabilities to the fullest extent permissible by law.

  6. Data and Online protection

    We take industry standard steps to protect our systems and seek to try to stop abuse and misuse.

    You are responsible for configuring your information technology, computer programmes and platform to access our site. Please ensure you have up to date fire walls and malware protections in place to protect your own equipment and personal information.

    Please also protect your own passwords.

    We will keep the basic amount of personal information on our system to enable us to deliver the service to you. You can read more about that in our privacy policy here .

    We will anonymise and aggregate site usage data which we will utilise at our discretion. You will not be identifiable in or from this data.

    We are NOT lawyers, accountants or consultants. Different rules of conduct apply to them. Ask them what they are.

    IMPORTANTLY - as we are not lawyers - any information you give to TAPTHEMARKET does not enjoy legal professional privilege. Your lawyer can explain this to you. Only include information in your Instructions that you are happy for lawyers you may potentially instruct to see.

    IMPORTANTLY your instructions are viewed by professionals registered on the site. Please don’t disclose anything confidential or upload any confidential documents you don’t want others who haven’t got a duty of confidentiality to you until you have formally appointed your professional and they do have a duty of confidentiality to you.

    We will only use information you provide as set out in these T&Cs.

    We have our own obligations under applicable laws and have to comply with the directions or reasonable requests of police, courts and other regulatory and competent bodies. This means, on occasions, to comply with applicable law or such requests we may have to disclose information to these parties. You expressly agree to this and agree to the way we exercise of our judgement as to whether to disclose.

    Any customer reviews or perhaps other blog or similar content is provided by you subject to our review and approval. We reserve the right to edit, remove some or all content or refuse to post such content at all.

    You consent to the professionals sharing with us details of the fees you are billed and pay to them.

  7. The Professionals

    The purpose of this service is for you to be able to cast your net and see what the market has to offer.

    Not all professionals in the market use www.tapthemarket.com and not all professionals using www.tapthemarket.com will respond to your Instructions.

    We do not guarantee, warrant or make any representation as to the suitability, competence, quality or performance of any professional.

    The decision as to whether you use any professional is purely a decision for you and for you alone. We don’t recommend, guide, direct or cajole. You instruct at your own risk based on your own judgment.

    Where you enter into a legal agreement with your professional utilising www.tapthemarket.com then the legal arrangement is still directly with that professional, not us.

    We urge that you do sign a clear client care letter with your appointed professional (this is good practice and lets you know exactly where you stand with that professional – including any regulatory body for that professional and their own internal procedure if you have any issues with their service).

  8. Customer reviews

    We are not responsible or liable in any way for the content of these reviews and as such we are not responsible if you rely upon the information within such reviews.

    If you subsequently disagree with any such review – then of course please post your own review.

    In creating your reviews, you accept that we have access to them to monitor them for compliance with our usage policy. You expressly accept this.

    As in paragraph 9 you agree to comply with social mores and good old-fashioned common courtesy with a healthy dose of mutual respect. We will delete any post or review that falls below our standards.

    Posts and reviews benefit from honesty and objective comment;

    A good starting place, but by no means a complete list, of what will be deleted upon us becoming aware of it is anything that is: rude, offensive, obscene, sexually explicit/inappropriate, racist or sexist, unlawful.

    If in any doubt as to whether it is appropriate, it probably isn’t..

    In keeping with other sites, any personal undisclosed relationship with the professional which renders any such posts or reviews biased must not be submitted.

  9. Using TAPTHEMARKET

    We don’t want people (and by that we mean you) to get into trouble. Therefore, please only submit Instructions for legal and lawful activities. It saves a lot of trouble later on.

    We want using this service to be as pleasant and trouble free as possible. To help us achieve this end, and your continued use of this service is dependent upon this, you agree that you will NOT:

    • Infringe TAPTHEMARKET or anyone else’s intellectual property rights (these are things like patents, copyrights, business and trade secrets and similar); This includes replicating or using in any way any aspect of the www.tapthemarket.com site without our prior written authority to do so.
    • Pretend to be someone else (there are other sites for that sort of thing) and or submit Instructions that you are not authorised to submit;
    • Provide false or misleading information;
    • Be rude, disrespectful or use any language which is either not in keeping with prevailing social mores and / or in TAPTHEMARKET’s sole opinion is inappropriate; We can delete any post or withdraw any Instructions without notice if we make such a judgment. We will not be liable for any loss that you occasion as a result.

    Your access to www.tapthemarket.com can be restricted or terminated without notice and without justification for any reason whatsoever.

    Please take proper and appropriate levels of care when using the site, including uploading files, that introduce corrupted materials, viruses, malware or similar that could in any way interfere with the normal running (including speed) of the site and impact the use by others of the site or any functionality of the site.

  10. Submitting Instructions

    These are down to you. We have provided a format which our experience has shown enables subsequent quotes to be easily compared and contrasted.

    There are lots of places for you to upload information and free form jazz tailored content to ensure the professional understands your requirements.

    As such content is down to you.

    You agree that we may need on certain occasions to assist in the drafting and delivery of the Instructions to professionals either for clarity or to comply with these T&Cs. As such you allow us to use the Instructions as we wish, in any format, in any media for as long as we decide is appropriate to facilitate the appointment of a professional.

    If this causes you a problem please don’t include any information you are concerned about in the Instructions.

  11. Intellectual Property Rights

    You may not think it but a lot of effort goes into this site. This makes us very protective of what we create. As such TAPTHEMARKET retains all rights, title and interest in any current or future intellectual property rights connected with www.tapthemarket.com. This covers matters such as software, images, text, graphics, illustrations, logos, service marks, copyrights, photographs, videos and music.

    This includes everything on the site (except where copyright is reserved by a third party). It also includes customer reviews and similar content. Please see paragraph 8 for more detail.

    No intellectual property rights shall transfer to you at any time. You do not have the right to use or do anything with any of our intellectual property. That’s a long non- exhaustive list of things you are not allowed to do. If in doubt, don’t do it. If still in doubt write to info@tapthemarket.com and ask your question, but still don’t do it.

    You are of course entitled to use the site for the purpose it is intended. And that’s it.

    To the extent you create content, you grant us a free of charge full and complete and perpetual licence to place that review on the site, and any other sites or channels including mobile, email, social media, press releases and similar for promotional purposes and to use it for the purpose intended, namely providing other users and potential users with your objective views of the professionals and or the site.

    You waive your moral rights in relation to any customer reviews, blog submissions or other customer provided content to the extent legally permitted.

  12. Limitation of Liability

    Again, sorry but everyone does it, firstly to survive nowadays but also it helps everyone know up front where they stand.

    We shall not be liable in contract, tort, negligence, statutory duty, misrepresentation, or otherwise for any loss or damage whatsoever arising from or in any way connected with your use of www.tapthemarket.com site or our associated services.

    Except as expressly set out in these terms and conditions, all conditions, warranties and obligations which may be implied or incorporated into them by statute or otherwise and any liabilities arising from them are expressly excluded to the fullest extent permitted by law.

    We shall not be liable for any loss of business, loss of profits, business interruption, loss of data, or any other economic or other loss whatsoever.

    In the event that any limitation or exclusion of liability in these terms and conditions is not enforceable, our liability to you in any event shall be a maximum of GBP 100 (£100) in aggregate.

    We don’t, of course, exclude or limit our liability to you where it would be unlawful to do so.

    Each individual provision of this paragraph shall be construed separately and independently.

  13. General

    These terms and conditions constitute the entire agreement as to your use of the www.tapthemarket.com site and associated services and supersedes all previous terms and conditions, written or oral arrangements, agreements and similar.

    We can vary the terms and conditions from time to time and upon change they will become immediately in full force and effect. You expressly agree to this and to any such new terms and conditions by continuing to use the site.

    If you do not like or agree to any terms and conditions you should stop using www.tapthemarket.com and its associated services immediately.

    These terms and conditions are subject to English law and the parties will submit to the exclusive jurisdiction of the English courts.

    If any provisions of these terms and conditions are illegal or for any reason unenforceable then just those provisions shall fail and the remainder of the terms and conditions shall survive and remain in full force and effect. If that is impossible as all the terms and conditions are effectively frustrated then they shall terminate immediately without any liability whatsoever to TAPTHEMARKET.

    You may not assign, transfer or sub contract any of your rights under these terms and conditions without our prior written authorisation.

    No waiver shall be in effect unless in writing.
